1. Acceptance of These Terms
Definitions
For the purposes of these Terms and Conditions:
- “Website” means https://vighnahartaa.com.
- “Services” means all spiritual, educational, healing, consultation, regression, meditation, digital, membership, and related services offered by Vighnahartaa through the Website or any other authorised platform.
- “Client”, “You”, or “Your” means any individual accessing the Website, booking, purchasing, or participating in any service offered by Vighnahartaa.
- “Content” means all text, videos, audio, recordings, case studies, blogs, articles, digital downloads, course materials, graphics, logos, documents, and other materials made available by Vighnahartaa.
- “Vighnahartaa”, “We”, “Us”, or “Our” means Vighnahartaa Consulting (Partnership Firm), having its principal place of business at Shop No. 9, S-3, Rajdhani Garden, Karoli, Abu Road, District Sirohi, Rajasthan – 307510, India.
By accessing, browsing, or using https://vighnahartaa.com (the “Website”), booking or purchasing any service, making any payment, or otherwise engaging with the services offered by Vighnahartaa, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, together with our Privacy Policy and any other policies expressly incorporated by reference.
These Terms and Conditions govern your access to and use of the Website, as well as all services, programmes, digital content, communications, and interactions provided by Vighnahartaa.
These Terms and Conditions also apply to all content and resources made available through the Website or by Vighnahartaa, including blogs, articles, videos, audio recordings, newsletters, downloadable materials, membership content, free resources, online communities, comments, digital products, and any other information or materials provided through the Website or our authorised platforms.
If you do not agree to these Terms and Conditions, you must not access or use the Website or book, purchase, or participate in any service offered by Vighnahartaa.
2. Nature & Scope of Services
Vighnahartaa provides spiritual, educational, and self-development services, including but not limited to Past Life Regression, Proxy Past Life Regression, Akashic Reading & Healing, energy healing, meditation guidance, spiritual consultations, group sessions, workshops, online programmes, digital content, and other complementary spiritual services.
All services offered by Vighnahartaa are intended to support self-awareness, personal growth, emotional wellbeing, and spiritual exploration. These services are complementary in nature and are not intended to replace professional medical, psychological, psychiatric, legal, financial, or other regulated professional advice or treatment.
Vighnahartaa does not diagnose, treat, cure, or prevent any physical, mental, psychological, psychiatric, neurological, or other medical condition. Clients should seek advice from appropriately qualified professionals regarding any medical, mental health, legal, financial, or other professional matters.
Experiences arising during sessions, including but not limited to intuitive impressions, energetic observations, regression experiences, Akashic insights, symbolic imagery, emotions, memories, or spiritual guidance, are inherently personal and subjective. Such experiences should not be interpreted as statements of objective fact, guarantees, predictions, or certainty regarding past, present, or future events.
By booking or participating in any service, you acknowledge that you understand the spiritual and experiential nature of the services and accept full responsibility for your own interpretations, decisions, and actions arising from your participation.
3. Client Eligibility, Health & Safety
To ensure the safety and suitability of our services, clients must carefully review and comply with the following eligibility requirements before booking or participating in any session.
Clients must be at least 18 years of age to independently book and participate in our services. If Vighnahartaa chooses, at its sole discretion, to provide services to a minor, participation shall require the prior knowledge and consent of a parent or legal guardian.
Certain services offered by Vighnahartaa involve hypnosis, deep relaxation, or altered states of awareness. These include, but are not limited to, Past Life Regression, Inner Child Healing, Womb Healing, Cord Cutting, Fear Healing, Addiction Healing, and any other hypnosis-based services offered from time to time. Clients intending to participate in such services must ensure that they are medically and psychologically fit to do so.
Clients must not participate in hypnosis-based services if they:
- are more than two (2) months pregnant;
- have suffered a stroke or heart attack within the preceding twelve (12) months;
- have any medical, neurological, psychiatric, or psychological condition that may make participation unsafe unless they have obtained prior approval from their treating healthcare professional;
- are 70 years of age or older, unless Vighnahartaa has expressly agreed to provide the service after considering the individual’s health and circumstances.
The above health-related restrictions apply only to services in which the client personally undergoes hypnosis or deep relaxation techniques. They do not apply to services such as Live Proxy Past Life Regression or Advanced Proxy Past Life Regression, where the client does not undergo hypnosis.
Clients are responsible for providing complete, accurate, and up-to-date information regarding their health, medications, and any other circumstances that may affect their participation. Any significant change in health occurring after booking but before the session must be communicated to Vighnahartaa without undue delay.
Vighnahartaa reserves the right to decline, postpone, modify, or discontinue any service where it reasonably believes that participation may be unsafe, unsuitable, or not in the client’s best interests. Where appropriate, clients may be advised to seek guidance from a qualified medical or mental health professional before participating.
By booking or participating in any service, you represent and warrant that you satisfy the applicable eligibility requirements set out in this Section and that the information you have provided to Vighnahartaa is true, complete, and accurate.
Our services are not intended for crisis intervention, emergency medical care, or emergency mental health support. If you believe you are experiencing a medical emergency, psychiatric emergency, or are at immediate risk of harm to yourself or others, you should immediately contact the appropriate emergency services or seek assistance from a qualified medical or mental health professional rather than relying on our services.
4. Appointments, Fees & Payment
Appointments may be requested through our Website, WhatsApp, email, or any other booking channel authorised by Vighnahartaa. All appointment requests are subject to availability and acceptance by Vighnahartaa.
The fees applicable to each service will be communicated to the client before the booking is confirmed or, where applicable, displayed on the Website. Unless expressly stated otherwise, full payment must be made in advance to secure an appointment. No booking shall be deemed confirmed until the applicable payment has been successfully received and Vighnahartaa has issued a booking confirmation.
Payments may be made through the payment methods approved by Vighnahartaa from time to time, including online payment gateways, bank transfers, UPI, or other authorised payment options. Clients are responsible for ensuring that all payment details provided are accurate and that sufficient funds are available to complete the transaction.
Clients are responsible for any bank charges, currency conversion fees, international transfer charges, payment gateway fees, or similar charges imposed by their financial institution or payment service provider. Such charges are separate from the fees charged by Vighnahartaa.
The fees applicable to future bookings may be revised at any time without prior notice. However, any change in pricing shall not affect appointments that have already been confirmed and paid for prior to the revised pricing taking effect.
If a payment is declined, reversed, disputed, or otherwise fails to clear, Vighnahartaa reserves the right to suspend, postpone, or cancel the booking until the outstanding amount has been received in full.
Unless expressly stated otherwise, all fees paid to Vighnahartaa relate solely to the specific service booked and do not include any future sessions, follow-up services, additional consultations, recordings, written reports, or other services unless separately agreed in writing.
5. Scheduling, Time Zones & Online Sessions
Unless expressly agreed otherwise in writing, all services offered by Vighnahartaa are conducted online through platforms such as Zoom, WhatsApp, or any other communication platform designated by Vighnahartaa.
Appointment dates, times, and joining instructions will be communicated to the client through WhatsApp, email, or any other contact method provided during the booking process. It is the client’s responsibility to ensure that the contact information provided is accurate and to regularly monitor these communication channels for updates relating to their appointment.
All appointment times are scheduled according to Indian Standard Time (IST) unless expressly stated otherwise. Clients residing outside India are solely responsible for converting the scheduled appointment time to their local time zone and joining the session at the correct time.
Clients are expected to join the session promptly at the scheduled time using the meeting link or communication method provided. Delays caused by incorrect time zone conversions, failure to check communications, or failure to access the meeting link shall be treated in accordance with the attendance and late arrival provisions set out in these Terms and Conditions.
Vighnahartaa reserves the right to conduct sessions through an alternative online platform where reasonably necessary due to technical issues, platform availability, security concerns, or other operational requirements. Where such changes occur, reasonable efforts will be made to inform the client in advance.
While Vighnahartaa will make reasonable efforts to conduct all appointments at the scheduled time, we reserve the right to reschedule an appointment due to circumstances beyond our reasonable control, including technical difficulties, illness, emergencies, internet disruptions, or other unforeseen events. In such cases, the client will be offered a mutually convenient alternative appointment at no additional charge.
6. Cancellation, Rescheduling, Refunds & Attendance
Clients may request to reschedule an appointment by providing at least seventy-two (72) hours’ prior notice before the scheduled appointment time. Subject to availability, Vighnahartaa will make reasonable efforts to accommodate one rescheduling request without any additional charge. Requests received less than seventy-two (72) hours before the scheduled appointment may be declined and treated as a cancellation.
Certain services require significant preparation before the live session, including but not limited to Akashic Reading & Healing and Advanced Proxy Past Life Regression. As preparatory work for these services begins soon after the booking is confirmed, the applicable fee becomes non-refundable once such preparation has commenced, irrespective of whether the client subsequently attends or completes the session.
If a client cancels an appointment after preparatory work has begun, fails to attend the scheduled session, arrives excessively late, leaves the session before its completion without a valid reason, or is unavailable at the scheduled time, Vighnahartaa reserves the right to treat the appointment as completed. In such cases, no refund, credit, or complimentary replacement session shall be provided, except where Vighnahartaa expressly agrees otherwise in writing.
Clients who anticipate being delayed should notify Vighnahartaa as soon as reasonably possible. While reasonable efforts may be made to accommodate minor delays, the scheduled end time of the appointment will ordinarily remain unchanged to avoid affecting subsequent appointments. Where a meaningful session can no longer be conducted due to the client’s delay, the appointment may be treated as a no-show.
If Vighnahartaa is unable to conduct a scheduled session due to illness, emergency, technical failure, or any other circumstance beyond our reasonable control, the appointment will ordinarily be rescheduled to a mutually convenient date and time. If rescheduling is not reasonably possible, a refund may be issued at Vighnahartaa’s sole discretion through the original payment method or any other appropriate method.
Approved refunds, where applicable, will generally be processed within a reasonable period. The actual time taken for the refunded amount to reflect in the client’s account may vary depending upon the payment gateway, banking institution, card issuer, or financial service provider. Any currency conversion charges, bank charges, payment gateway fees, or similar transaction costs imposed by third parties may be deducted where permitted by applicable law or may not be recoverable.
Nothing in this Section prevents Vighnahartaa from making reasonable exceptions in exceptional or compassionate circumstances where we believe such an exception is appropriate. Any such exception shall be entirely discretionary and shall not create a precedent or entitlement for future bookings.
7. Client Responsibilities & Participation
Clients are expected to participate in all services honestly, respectfully, and in good faith. By booking or participating in any service, clients agree to provide complete, accurate, and truthful information regarding their personal circumstances, health, concerns, and objectives, to the extent reasonably necessary for the delivery of the requested service.
Participation in all services is entirely voluntary. Clients remain free to pause or discontinue a session at any time. However, a client’s decision to stop or withdraw from a session after it has commenced shall not, by itself, entitle the client to a refund, credit, or replacement session, except where Vighnahartaa expressly agrees otherwise.
Many of the services offered by Vighnahartaa require the client’s active participation, openness, focus, and willingness to engage with the process. The quality and nature of a client’s experience may be influenced by numerous factors, including their level of participation, mindset, emotional readiness, and individual circumstances, all of which remain beyond Vighnahartaa’s control.
Clients are solely responsible for the decisions, actions, and interpretations they make before, during, or after participating in any service. Vighnahartaa encourages clients to exercise their own judgment and, where appropriate, seek guidance from suitably qualified professionals before making important medical, psychological, legal, financial, or other significant life decisions based on their session experience.
Vighnahartaa reserves the right to refuse, suspend, postpone, or discontinue any booking or service at its sole discretion where a client’s request, conduct, or intended use of the services is unlawful, unethical, fraudulent, abusive, threatening, harassing, or otherwise inconsistent with our spiritual values, professional standards, or these Terms and Conditions. In such circumstances, any refund shall be governed by the applicable provisions of these Terms and Conditions.
Clients are expected to communicate respectfully with Vighnahartaa and refrain from abusive, threatening, discriminatory, harassing, or otherwise inappropriate behaviour towards our practitioners or staff. Vighnahartaa reserves the right to suspend, terminate, or refuse any service without refund where a client’s conduct is considered abusive, disruptive, unsafe, or otherwise inappropriate.
8. No Guarantee of Outcomes
Vighnahartaa provides its services with reasonable care, skill, and professional diligence. However, due to the inherently personal, spiritual, and experiential nature of the services offered, no representation, warranty, or guarantee is made regarding any specific outcome, result, experience, or benefit.
Each client’s experience is unique and may differ significantly from that of another individual. Some clients may experience vivid memories, emotions, insights, imagery, or a profound sense of clarity, while others may experience subtle, limited, or no noticeable effects. The absence of a particular experience does not indicate that the service has been improperly performed.
Vighnahartaa does not guarantee that any client will:
- recall past life memories;
- experience visions, intuitive insights, or spiritual phenomena;
- receive specific answers or guidance;
- achieve emotional, physical, psychological, spiritual, or financial improvement;
- resolve any personal, relationship, health, career, or life challenge; or
- obtain any other desired outcome as a result of participating in our services.
Clients acknowledge and agree that payment made to Vighnahartaa is solely for the practitioner’s professional time, expertise, preparation, and delivery of the requested service, and not for any guaranteed result or outcome.
Accordingly, dissatisfaction with the nature of a client’s experience, the absence of expected results, or the failure to achieve a desired personal outcome shall not, by itself, constitute grounds for a refund, replacement session, compensation, or legal claim against Vighnahartaa.
9. Technical Requirements & Session Environment
Clients are responsible for ensuring that they have the necessary equipment and environment required to participate effectively in online sessions. This includes access to a reliable internet connection, a suitable computer, tablet, or smartphone, a functioning camera and microphone where required, and any software or applications specified by Vighnahartaa, such as Zoom or other designated communication platforms.
Clients are expected to join each session from a quiet, private, and interruption-free environment where they can participate comfortably and safely. To ensure the effectiveness of the session, clients should minimise distractions by informing household members in advance, keeping children and pets away from the session area where reasonably possible, silencing mobile phone notifications, and avoiding interruptions from visitors or other activities.
It is the client’s responsibility to test their internet connection, audio, video, device battery, and any required software before the scheduled appointment. Vighnahartaa shall not be responsible for delays, interruptions, reduced session time, or inability to deliver a session where such issues arise from the client’s equipment, internet connection, software, power supply, or technical setup.
If a session is interrupted due to a technical issue on the client’s side, Vighnahartaa will make reasonable efforts to reconnect and continue the session where practicable. However, if the session cannot reasonably continue because of the client’s technical difficulties, internet failure, or unsuitable environment, the appointment may be treated as completed, and the cancellation and attendance provisions of these Terms and Conditions shall apply.
Where a technical failure occurs on Vighnahartaa’s side that materially prevents the delivery of the scheduled service, reasonable efforts will be made to reconnect, continue, or reschedule the session at no additional cost to the client.
10. Confidentiality, Recordings & Privacy
Vighnahartaa respects the privacy and confidentiality of its clients and will treat all personal information shared during the course of providing our services with appropriate care and discretion. Information disclosed during consultations, healing sessions, or other services will not be knowingly shared with third parties except as permitted by these Terms and Conditions, our Privacy Policy, or where required by applicable law.
Notwithstanding the foregoing, Vighnahartaa reserves the right to disclose information where such disclosure is reasonably necessary to comply with a legal obligation, court order, governmental or regulatory request, or where we reasonably believe disclosure is necessary to protect the rights, safety, or property of Vighnahartaa, our practitioners, our clients, or any other person.
Certain sessions may be recorded by Vighnahartaa for purposes including quality assurance, training, record-keeping, or where a recording forms part of the service purchased by the client. Where recording is not an integral part of the service, Vighnahartaa will obtain the client’s consent before recording the session where required by applicable law.
Unless expressly authorised in writing by Vighnahartaa, clients shall not record, photograph, livestream, reproduce, distribute, publish, or otherwise share any session or any part thereof through any medium or platform.
Where a recording is provided to a client as part of a purchased service, it is supplied solely for the client’s personal and non-commercial use. All intellectual property rights in such recordings remain vested in Vighnahartaa, and the client shall not copy, edit, reproduce, upload, sell, publicly share, distribute, or otherwise use the recording without our prior written permission.
Vighnahartaa regularly prepares educational content based on real client sessions, including but not limited to case studies, books, articles, videos, podcasts, social media content, workshops, seminars, online courses, and other educational or spiritual materials, for the purpose of public education, spiritual awareness, research, and personal growth. By booking or participating in any service, you expressly acknowledge, understand, and consent to Vighnahartaa using information derived from your session for these purposes.
In preparing such educational content, Vighnahartaa will make reasonable efforts to protect the client’s identity by removing, modifying, or omitting personally identifiable information, including but not limited to names, photographs, precise locations, occupations, contact details, family identities, and other identifying characteristics wherever reasonably practicable. Vighnahartaa may also edit, summarise, rearrange, combine, or present session information in a manner considered appropriate for educational purposes, provided that such presentation is not intended to reveal the identity of the client. However, due to the unique nature of individual life experiences, complete anonymity cannot be absolutely guaranteed, and clients acknowledge and accept this inherent limitation.
Clients acknowledge that the educational content prepared from their session is intended solely for educational, spiritual, and public awareness purposes and is not intended to identify, defame, embarrass, or publicly disclose the identity of any individual. By participating in our services, clients expressly waive any objection to the publication or use of suitably anonymised session content in accordance with this Section.
The collection, use, storage, processing, and protection of personal information are governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. By using our Website or services, you acknowledge that you have read, understood, and agree to the collection, use, storage, and processing of your personal information in accordance with our Privacy Policy.
11. Intellectual Property
Unless otherwise expressly stated, all content available on the Website and all materials created, provided, or made available by Vighnahartaa, including but not limited to text, articles, blogs, case studies, videos, audio recordings, meditations, course materials, session recordings, PDFs, worksheets, graphics, logos, trademarks, designs, software, website layout, branding elements, photographs, illustrations, and other educational or digital content (collectively, the “Content”), are the exclusive intellectual property of Vighnahartaa or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.
Subject to these Terms and Conditions, Vighnahartaa grants clients a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Content solely for their personal, private, and non-commercial use.
Except with the prior written permission of Vighnahartaa or as expressly permitted by applicable law, no person may copy, reproduce, modify, adapt, translate, distribute, publish, transmit, display, perform, sell, license, create derivative works from, reverse engineer, commercially exploit, or otherwise use any part of the Content for any commercial or public purpose.
The purchase of a service, recording, course, consultation, workshop, digital product, or any other offering does not transfer any ownership or intellectual property rights to the client. All such rights shall remain solely vested in Vighnahartaa.
Clients shall not remove, alter, obscure, or tamper with any copyright notice, trademark, logo, watermark, branding, disclaimer, or other proprietary notice appearing on any Content provided by Vighnahartaa.
Any unauthorised use of the Content may constitute an infringement of copyright, trademark, or other intellectual property rights and may result in the suspension or termination of access to our services, in addition to any civil or criminal remedies available under applicable law.
If you believe that any content available on our Website infringes your intellectual property rights, you may contact Vighnahartaa with reasonable details of your claim, and we will review the matter in accordance with applicable law.
12. Website Use & Acceptable Conduct
By accessing or using the Website or any services offered by Vighnahartaa, you agree to use them lawfully, responsibly, and in a manner that does not infringe the rights of Vighnahartaa or any third party.
You agree that you shall not, directly or indirectly:
- use the Website or our services for any unlawful, fraudulent, defamatory, abusive, threatening, harassing, discriminatory, or malicious purpose;
- impersonate any person or entity or falsely represent your identity or affiliation with any person or organisation;
- submit false, misleading, incomplete, or inaccurate information while booking services or communicating with Vighnahartaa;
- interfere with, disrupt, damage, overload, or compromise the security, integrity, or proper functioning of the Website, servers, networks, software, or related systems;
- introduce or transmit viruses, malware, ransomware, spyware, worms, malicious code, or any other harmful technology;
- attempt to gain unauthorised access to any portion of the Website, our systems, client information, accounts, or networks;
- copy, scrape, harvest, extract, or use automated tools, bots, spiders, crawlers, or similar technologies to collect information or content from the Website without our prior written permission;
- upload, publish, transmit, or distribute any content that infringes the intellectual property, privacy, publicity, or other legal rights of any person;
- use the Website or our services in any manner that could damage the reputation, goodwill, or legitimate interests of Vighnahartaa;
- misuse, reproduce, distribute, or publicly share any educational material, recordings, reports, or other content provided by Vighnahartaa in violation of these Terms and Conditions; or
- encourage, assist, or facilitate any other person to engage in any activity prohibited under this Section.
Vighnahartaa reserves the right to investigate any suspected misuse of the Website or our services and may, at its sole discretion and without prior notice, suspend or terminate access to the Website or any service where it reasonably believes that these Terms and Conditions have been violated. Such action shall be without prejudice to any other legal or equitable remedies available to Vighnahartaa under applicable law.
Clients shall remain solely responsible for any information, communication, or material submitted by them through the Website or during the course of using our services and warrant that such information does not violate any applicable law or the rights of any third party.
13. Third-Party Platforms & External Links
Vighnahartaa may use or provide access to third-party platforms, software, payment gateways, communication services, websites, or other technologies in connection with the delivery of its services. These may include, but are not limited to, Zoom, WhatsApp, Google Meet, YouTube, Razorpay, payment gateways, email service providers, cloud storage providers, social media platforms, and similar third-party services.
Such third-party platforms are owned and operated by their respective providers and are governed by their own terms of service, privacy policies, and operating practices. Vighnahartaa does not own, control, endorse, or assume responsibility for the availability, security, functionality, content, or policies of any third-party platform.
Clients acknowledge and agree that their use of any third-party platform is entirely at their own risk and subject to the applicable terms and policies of the respective provider. Vighnahartaa shall not be liable for any interruption, delay, data loss, technical malfunction, unauthorised access, security breach, service outage, payment failure, or other issue arising from or attributable to any third-party platform or service provider.
The Website may contain links to external websites or resources provided solely for the convenience of users. Such links do not constitute an endorsement, recommendation, or approval by Vighnahartaa of any third-party website, organisation, product, or service. Vighnahartaa is not responsible for the content, accuracy, availability, legality, or practices of any external website and accepts no liability arising from your access to or use of such websites.
Vighnahartaa reserves the right to add, remove, replace, or discontinue the use of any third-party platform or service provider at any time where reasonably necessary for operational, technical, security, or business reasons, without incurring any liability to clients.
By using our Website or participating in our services, you acknowledge and agree that Vighnahartaa shall not be responsible for any loss, damage, expense, or inconvenience arising directly or indirectly from the use of any third-party platform, payment gateway, communication service, or external website.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Vighnahartaa, its partners, practitioners, employees, associates, representatives, affiliates, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages, losses, costs, or expenses arising out of or relating to the use of the Website, participation in any service, reliance upon any information or guidance provided, or the inability to access or use our Website or services.
Without limiting the generality of the foregoing, Vighnahartaa shall not be liable for any loss or damage arising from or relating to:
- a client’s interpretation or application of information, guidance, or experiences obtained during any session;
- decisions or actions taken or not taken by a client before, during, or after participating in any service;
- the failure to achieve any expected, desired, or anticipated outcome;
- emotional, psychological, spiritual, financial, professional, or relationship consequences experienced by a client;
- technical failures, internet interruptions, software errors, hardware malfunctions, or communication failures;
- the acts, omissions, policies, or failures of third-party platforms, payment gateways, internet service providers, or other external service providers;
- unauthorised access to, or alteration of, data transmitted over the internet despite reasonable security measures;
- delays, interruptions, cancellations, or inability to provide services resulting from circumstances beyond the reasonable control of Vighnahartaa; or
- any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of income, business opportunities, goodwill, reputation, data, or anticipated savings.
Clients acknowledge that all services provided by Vighnahartaa are of a spiritual, educational, and self-development nature and that any decisions made or actions taken based on such services are made entirely at the client’s own discretion and risk.
To the maximum extent permitted by applicable law, the total cumulative liability of Vighnahartaa arising out of or relating to any claim, whether in contract, tort (including negligence), statutory duty, or otherwise, shall not exceed the amount actually paid by the client to Vighnahartaa for the specific service giving rise to the claim.
Nothing contained in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law.
15. Indemnity
